1. General information
For us, Mana Health Technologies GmbH, Mosconweg 18, 8047 Graz (hereafter Mana Health), protecting the personal data of our customers is extremely important. This privacy policy explains how, to what extent, and for what purposes we obtain and process your personal data. 2. What are personal data?
Personal data are pieces of information which refer to people whose identity is or can be identified (name, address, data of birth, etc.).

Mana Health processes your personal data which Mana Health obtains in the course of the business relationship with you and which are required for performance of the contract or for provision of services. These personal data include the following information that Mana Health obtains directly from you:

–Your personal details (name, address, date of birth, email address, contact details, etc.)
–Your payment details (IBAN, BIC)
–Order details (e.g. payment orders)

4. For which purposes and on what legal basis do we process these data?
Mana Health processes your personal data for the following purposes:
–For performance of a contract or for compliance with contractual obligations (Art. 6 (1) (b) GDPR) in the course of a business relationship;
–On the basis and within the scope of the consent that you have given (Art. 6 (1) (a) GDPR), provided that you have given Mana Health your consent;
–To comply with Mana Health’s legal obligations (Art. 6 (1) (c) GDPR).

Your data are processed to initiate and conduct our business relationship and/or to perform the respective contract.If your consent is required for processing, Mana Health will seek to obtain this consent from you.Consent is always voluntary. If you give Mana Health your consent for the processing of your personal data for specific purposes, the data will be processed on the basis of this consent, in accordance with the purposes specified in the declaration of consent, and within the agreed scope. If you have given us your consent, you can withdraw this consent at any time with effect for the future by sending us a letter or by emailing office@manadental.at. This does not affect the lawfulness of the data processing carried out until you withdraw your consent. You are not required to give your consent for the processing of your personal data.

5. Are you required to give us your personal data? What happens if you do not want to do this?
Mana Health relies on your personal data in order to initiate and conduct the business relationship. If you do not give Mana Health your personal data, Mana Health will in most cases be forced to decline to enter the contract, or we will no longer be able to perform an existing contract and must therefore terminate it. 

6. Will your data be passed on to third parties?
Mana Health will only pass on your data to third parties if this is required for the respective purpose.
At Mana Health, only those staff/departments which require your data in order to comply with our company’s contractual and/or legal obligations and/or for processing in accordance with your consent will have access to your data.

For the stated purposes, we may need to disclose your personal data to the following recipients through transmission, dissemination or any other form of provision:
–IT companies for the provision, maintenance and support of the Mana Health IT system and for data processing purposes related to IT systems;
–Tax consultants and accountants for the purpose and in the interest of supporting compliance with Mana Health’s tax obligations (Austrian Corporate Code (UGB), Austrian Federal Fiscal Code (BAO), etc.);
–Marketing partners (graphic designers, advertising agencies, printers, shippers, telephone marketing, newspaper publishers);
–Legal representatives, security agencies, courts of jurisdiction, legal prosecution agencies, financial authorities;
–Delivery service providers, in the course of conducting the business relationship.

Some of the recipients mentioned above may be based in another country, or they may process your personal data in another country. The level of data privacy in other countries may vary. However, either Mana Health will send your personal data solely to countries which the EU Commission has decided offer a suitable level of data privacy, or Mana Health will take steps to ensure that all recipients offer a suitable level of data privacy.

7. How long does Mana Health store your personal data?
Mana Health will only store your data for as long as required for the purpose for which Mana Health obtained your data. In any case, Mana Health will store your personal data for as long as legal retention obligations (UGB, BAO, etc.) apply, or until limitation periods for potential legal claims expire.

8. Does Mana Health make decisions based on automated processing, e.g. profiling?
Mana Health does not use automated decision-making processes, including profiling, as specified in Art. 22 GDPR.

9. Does Mana Health use cookies?
9.1 Our platform uses cookies, text files which are stored in or by the internet browser on a user’s computer or device.When a user visits a website, a cookie may be saved on their computer or device. This cookie contains a character string which allows the user to be uniquely identified when they visit the website again. Mana Health uses cookies for statistical purposes. Mana Health produces generic statistics in order to enhance our platform so that it better meets the needs of its users.These statistics and anonymised, and the individual data cannot be traced to any specific person or IP address. Mana Health has the right to use these anonymous statistics for its own purposes, and to pass on these statistics to third parties.The following data are stored and transmitted in the cookies:
–Language settings
–Login details 

Mana Health also uses cookies on our platform which enable analysis of users’ browsing behaviour.The following data may be transmitted as a result:
–Search terms entered
–How often pages are visited
–Which/how website features are used

Technical steps are taken to pseudonymise the user data collected in this way, which means the data cannot be associated with the user of the platform. The data are stored separately from the user’s other personal data.
When a user visits our website, they will be informed of the use of cookies for analytics purposes, and their consent for the processing of the personal data used for these purposes will be sought. The cookie notice also includes a link to this privacy policy. Your web browser transmits the data mentioned above to us when you visit our website. 

9.2 Legal basis for data processing with cookies
The legal basis for processing personal data using essential cookies is Art. 6 (1) (f) GDPR.The legal basis for processing personal data using cookies for analytics purposes is consent given by the user for this purpose (Art. 6 (1) (a) GDPR).

9.3 Purpose of data processing for cookies
The purpose of using essential cookies is to make website easier for visitors to use. Without using cookies, we cannot offer some features of our platform. For these features, your browser must be recognised after you move from one page to another.
We need cookies for the following features:
–Applying language settings
–Remembering search terms
–Saving/restoring your basket
–Restoring your session 

The user data obtained by essential cookies are not used to create user profiles.
Analytics cookies are used for the purpose of improving the quality of our platform and its content. The analytics cookies tell us how our platform is used so that we can continuously optimise the service we offer.These purposes encompass our legitimate interest in processing personal data in accordance with Art. 6 (1) (f) GDPR.

The data are also obtained in order to prevent misuse of our services.

10. What rights do you have with regard to data processing?
Your legal rights include:
–checking whether Mana Health is processing your personal data and if so which, and receiving copies of these data;
–obtaining the rectification and completion of personal data;
–obtaining the erasure of personal data;
–restricting the processing of personal data;
–objecting to the processing of personal data;
–obtaining data portability;
–knowing the identity of third parties to whom personal data have been sent. 

If Mana Health processes your data on the basis of your consent, you have the right to withdraw this consent at any time, either by emailing office@manadental.at or by sending a letter to Mana Health Technologies GmbH, Mosconweg 18, 8047 Graz. This does not affect the lawfulness of the data processing carried out until you withdraw your consent.

You also have the right to lodge a complaint with the Austrian supervisory authority for data privacy or with another supervisory authority for data privacy in the EU, in particular in your place of residence or place of work.
